10 Questions About the Sandra Bland Tape

Dear Texas Department of Public Safety,

Thank you for releasing the dash cam footage of the confrontation between Texas State Trooper Brian T. Encinia and the motorist Sandra Bland.

I have 10 questions.

1.  In the video, Texas State Trooper Brian T. Encinia made a traffic stop before his encounter with Sandra Bland, and in this traffic stop, Officer Encinia approached the car on the driver's side. Why did Officer Encinia approach the car on thepassenger's side when he interacted with Sandra Bland?

2.  The tape revealed that Officer Encinia released his gun holster before he approached Sandra Bland's car. Is this standard practice with all traffic stops? If so, did Officer Encinia also release his gun holster in the first traffic stop shown on the video?

3.  Can you clarify why the first driver Officer Encinia stopped--the driver that did not have proof of insurance--was not asked to step out of his/her vehicle, but Sandra Bland was forcibly removed from her car? To be blunt, was Sandra Bland forcibly removed from her car because Officer Encinia didn't like her attitude?

4.  At the 10:17 mark in the video, Officer Encinia radios "10:98," and requests a second car. Well, a 10:98 is a jail break, or an escaping prisoner. A 10:78, that is, "assistance needed" would have been more appropriate, since Sandra Bland was still INSIDE the car and had not escaped, correct?

5.  When a detainee notifies the arresting officer of a preexisting medical condition, such as epilepsy, and/or an injury sustained during the arrest, are paramedics called to the scene?

6.  Looking back on everything that has transpired since the arrest of Sandra Bland, I have one question for the female police officer that arrived on the scene: How you doin'? Do you feel you fully exercised your unique position as a female police officer to use your voice and presence to calm this irate twenty-something woman down? Something like, "Look, Ms. Bland, you're not in Chicago, you're in Texas. Woman-to-woman, you must tone it down if you want to be heard," may have deescalated the situation. From what I heard on the tape, you were escalating the situation.

7.  Why are two police officers searching the vehicle so thoroughly for a minor traffic stop? One officer even pats the rooftop--looking for a secret stash of drugs, maybe? Would Sandra Bland's Illinois license plates have anything to do with this?

8.  At the 25:20 mark, the tow truck driver disappears and then magically reappears. Is that poor editing, or a magic trick that tow truck drivers learn in Texas?

9.  Did Sandra Bland have a right to know why she was being arrested? She clearly asked, several times.

10.  Did anyone recite Sandra Bland's Miranda rights? Did she know that she had a right to remain silent? Or did someone force the silence upon her after the fact?

Alan: Blacks are arrested - and prosecuted - at least twice as often as whites for the same "contraband" crimes white people at the same rate. 

If white people were incarcerated as often as blacks for the crimes both commit with the same regularity, and if blacks were incarcerated for the crimes they commit as often as whites are for those same crimes, the "black prison time" figure of 32% (above) would be cut in half and the "white prison time" figure of 6% would double.

The situation is further complicated because it is much harder for released blacks to find work than it is for released whites, making persistent black unemployment a source of recidivism.
