The House Judiciary Committee has approved the impeachment of President Trump, but Congressional Republicans correctly note that one difference between this impeachment process and previous ones is the lack of even a wisp of bipartisanship this time around.

Yet the fundamental difference between this impeachment and previous ones is more complicated. It’s not the difference between, say, Richard Nixon’s abuse of power and Donald Trump’s: Their offenses were similar, involving the abuse of government power to injure the political opponents. Rather, the fundamental difference is the way the Republican Party — empowered by Fox News — has smothered Trump in its embrace and seems uninterested in a good-faith investigation. And that’s the topic of my column today.

Incidentally, it’s not quite as clear as people think that President Bill Clinton committed perjury in the Monica Lewinsky affair. Clinton clearly misled the grand jury and in any normal use of the word, he lied about the affair. But he is a quite brilliant lawyer who had clearly read the case law involving perjury, and he managed to navigate very delicately in ways that arguably avoided the technical offense of perjury. Reading the law review article on this subject reminded me how I once loved the law (while studying law, I was in some danger of becoming a law professor; then I went to Egypt and escaped into journalism).
