Since taking back the U.S. House of Representatives, Democrats have been using their new investigative reach to open probes into various parts of the Trump administration.
With full committee control, House Democrats have the power to hold unethical people and policies to account, but they have yet to fulfill a midterm promise: to investigate Brett Kavanaugh.
Kavanaugh faced 83 ethics complaints related to his conduct at his confirmation hearings. In December, a federal panel of judges concluded that while the complaints “‘are serious,’ there is no existing authority that allows lower court judges to investigate or discipline Supreme Court justices.” Congress, however, would not face this problem, thus allowing a House committee controlled by Democrats to conduct an investigation.
The 83 complaints aren’t all, though. House committees can open a probe into Kavanuagh’s 2004 and 2006 perjury or misleading congressional testimony. They could also investigate the numerous sexual assault allegations against him if Dr. Christine Blasey Ford, Deborah Ramirez, and Julie Swetnick gave them the go-ahead.
There is no good reason to delay an investigation any longer. A congressional probe is the only way to hold Kavanaugh accountable—and with Republicans’ undying loyalty to Trump, it will have to start in the House.
